Agricola Perseveranza (VAT: 04046020360) (hereinafter &#8220;PERSEVERANZA&#8221;), with its registered office at Via Enrico Misley, 12\/03, Modena, in its capacity as Data Controller pursuant to Articles 4(7) and 24 of Regulation (EU) No. 2016\/679 (GDPR), informs you that, in accordance with Article 13 of the GDPR, it provides below the cookie policy (&#8220;Policy&#8221;) applicable exclusively to the present website www.cantinaperseveranza.it (the &#8220;Website&#8221;).<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">1.Legal Framework<strong>.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>1.1.<\/strong>&nbsp;The Policy is based on the following regulatory measures (first-level and\/or second-level) both at the EU and national levels: (i) Directive 2002\/58\/EC of 12.7.2002 (the so-called ePrivacy Directive), as amended by Directive 2009\/136\/EC; (ii) Article 122 of the amended Legislative Decree no. 196\/2003 (Privacy Code), which transposed the ePrivacy Directive into the national legal system; (iii) GDPR: Articles 4(11), 7, 12, 13, 25, and 95 (in particular Recitals 30, 32, and 173); (iv) Guidelines no. 5\/2020 adopted on 4.5.2020 by the EDPB, replacing the Guidelines of 10.4.2018 by WP Article 29; (v) Provision no. 231 of 10.6.2021 [web document no. 9677876] issued by the Italian Data Protection Authority (Garante Privacy); (vi) Recommendation no. 2\/2001 by WP Article 29; (vii) Opinion no. 2\/2010 by WP Article 29; (viii) Opinion no. 4\/2012 by WP Article 29; (ix) Guidelines no. 8\/2020 by the EDPB.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">2. <strong>Cookies<br>and Other Tracking Tools: Definition and Classification.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.1.<\/strong>&nbsp;\u201ccookies\u201d<a href=\"https:\/\/enterprime.it\/cookie-policy\/#_ftn1\">[1]<\/a>&nbsp;are generally text strings that a website (&#8220;publisher&#8221; or &#8220;first party&#8221;) visited by the user or a different website (&#8220;third party&#8221;) places and stores, directly (in the case of the first-party website) or indirectly (through the first-party site, in the case of the third-party site), within a terminal device available to the user. In this regard, the Italian Data Protection Authority (Garante Privacy) has specified that the information encoded in cookies may include both personal data pursuant to Article 4(1) of the GDPR (e.g., IP address, username, email address, unique identifier) and non-personal data pursuant to Article 3(1) of Regulation (EU) No. 1807\/2018 (e.g., language, type of device used). Alongside (or in addition to) these, &#8220;other tracking tools&#8221; may exist (and therefore be used), which can be divided into &#8220;active&#8221; (which have almost the same characteristics as cookies) and &#8220;passive&#8221; (e.g., fingerprinting).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>2.2.<\/strong>&nbsp;Beyond their intrinsic characteristics, cookies (and other tracking tools) may vary in terms of duration (and thus be considered as &#8220;session&#8221; or &#8220;permanent&#8221; cookies depending on their duration), in terms of the entity (depending on whether the publisher acts independently or on behalf of a &#8220;third party&#8221;), and, most importantly, in terms of the processing purpose pursued. Therefore, they can be categorized into two broad categories:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201c<strong>Technical<\/strong>\u201d, used solely to &#8220;carry out the transmission of a communication over an electronic communications network, or as strictly necessary for the provider of an information society service explicitly requested by the subscriber or user to provide the service&#8221; (Article 122(1) of the Privacy Code).<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">In this regard, the Garante Privacy has clarified in Provision no. 231 of 10.6.2021 (consistent with the previous Provision of 2014) that &#8220;analytics cookies&#8221; <a href=\"https:\/\/enterprime.it\/cookie-policy\/#_ftn4\">[4]<\/a>&nbsp;can be included within the scope of &#8220;technical&#8221; cookies (and therefore can be used without the prior consent of the data subject) under certain conditions aimed at preventing the direct identification of the data subject. <a href=\"https:\/\/enterprime.it\/cookie-policy\/#_ftn5\">[5]<\/a>.<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>\u201c<strong>Profiling\/Marketing\u201d<\/strong>&nbsp;(so-called non-technical), used to associate specific actions or recurring behavioral patterns in the use of functionalities offered (patterns) with specific, identified, or identifiable subjects, for the purpose of grouping different profiles into homogeneous clusters of various sizes, enabling the Data Controller to provide increasingly personalized service, beyond what is strictly necessary for service provision, as well as to send targeted advertising messages (i.e., aligned with the preferences expressed by the user during web browsing).<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\">3. <strong>Cookies Installed on the Website.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>3.1.&nbsp;<\/strong>The following types of cookies have been installed (or may be installed with the user&#8217;s specific consent) on the Website:<\/p>\n\n\n\n<figure class=\"wp-block-table\"><table class=\"has-fixed-layout\"><tbody><tr><td><strong>Name<\/strong><\/td><td><strong>Type<\/strong><\/td><td><strong>Function\/Data collected<\/strong><\/td><td><strong>First\/Third part<\/strong>y<\/td><td><strong>Duration<\/strong><\/td><\/tr><tr><td>wp-wpml_current_language<\/td><td>Functional<\/td><td>WordPress multilingual plugin sets this cookie to store the current language\/language settings.<\/td><td>1 year 1 month 4 days <\/td><td>Session<\/td><\/tr><tr><td>_ga_*<\/td><td>Analytics<\/td><td>Google Analytics sets this cookie to store and count page views.<\/td><td>Third party<\/td><td>1 giorno<\/td><\/tr><tr><td>_ga<\/td><td>Analytics<\/td><td>Google Analytics sets this cookie to calculate visitor, session and campaign data and track site usage for the site&#8217;s analytics report. PERSEVERANZA notes that if the user decides to disable the technical cookies referred to in Article 2.2(i), the quality and speed of the services and functionalities offered and made available by the Website may deteriorate. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Information on how to manage cookies in some of the most popular browsers can be found by visiting the following web pages:<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/support.google.com\/chrome\/answer\/95647?hl=it\">https:\/\/support.google.com\/chrome\/answer\/95647?hl=it<\/a><br><a href=\"https:\/\/support.mozilla.org\/it\/kb\/Gestione%20dei%20cookie?redirectlocale=enUS&amp;redirectslug=Cookies\">https:\/\/support.mozilla.org\/it\/kb\/Gestione%20dei%20cookie?redirectlocale=enUS&amp;redirectslug=Cookies<\/a><br><a href=\"https:\/\/support.microsoft.com\/it-it\/help\/17442\">https:\/\/support.microsoft.com\/it-it\/help\/17442<\/a><\/p>\n\n\n\n<h3 class=\"wp-block-heading\">5. <strong>Rights of the data subject.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.1.<\/strong>&nbsp;Regarding the user&#8217;s personal data, PERSEVERANZA informs that the data subject, as defined by Article 4, paragraph 1 of the GDPR, has the right to exercise the following rights, subject to the limitations provided by Articles 2-undecies and 2-duodecies of the Italian Privacy Code:&nbsp;Right of access (Article 15 of the GDPR): The right to obtain confirmation as to whether or not personal data concerning them is being processed, as well as the information outlined in Article 15 of the GDPR (e.g., purpose of processing, retention period). Right to rectification (Article 16 of the GDPR):The right to correct, update, or complete personal data. Right to erasure (Article 17 of the GDPR): The right to obtain the deletion, destruction, or anonymization of personal data, provided the conditions listed in the same article are met. Right to restriction of processing (Article 18 of the GDPR): A significantly precautionary right aimed at obtaining the limitation of processing when the conditions outlined in Article 18 are met. Right to data portability (Article 20 of the GDPR): The right to obtain personal data provided to PERSEVERANZA in a structured, commonly used, and machine-readable format (and, if requested, to have it transmitted directly to another data controller), provided the specific conditions set out in the same article are met (e.g., legal basis of consent and\/or contract execution; personal data provided by the data subject). Right to object (Article 21 of the GDPR): The right to permanently stop a specific processing of personal data. Right to lodge a complaint with the Supervisory Authority (Italian Data Protection Authority, Garante Privacy) (Article 77 of the GDPR):The right to lodge a complaint if it is believed that the processing in question violates national and EU data protection laws.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.2.<\/strong>&nbsp;In addition to the rights described in the previous Article 6.1.), PERSEVERANZA specifies that, regarding the data subject&#8217;s personal data, there is the possibility, where applicable, to exercise, on one hand, the (sub)right provided for in Article 19 of the GDPR (&#8220;The data controller shall communicate any rectification or erasure of personal data or restriction of processing carried out in accordance with Article 16, Article 17(1), and Article 18 to each recipient to whom the personal data have been disclosed, unless this proves impossible or involves disproportionate effort. The data controller shall inform the data subject about those recipients if the data subject requests it&#8221;), which is considered related to the exercise of one or more rights regulated by Articles 16, 17, and 18 of the GDPR; on the other hand, PERSEVERANZA specifies that, regarding the data subject&#8217;s personal data, there is the possibility, where applicable, to exercise the right provided for in Article 22, paragraph 1) of the GDPR (&#8220;The data subject shall have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning them or similarly significantly affects them&#8221;), without prejudice to the exceptions provided for in the following paragraph 2).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.3.<\/strong>&nbsp;In compliance with Article 12, paragraph 1) of the GDPR, PERSEVERANZA undertakes to provide the user with the communications referred to in Articles 15 to 22 and 34 of the GDPR in a concise, transparent, intelligible, and easily accessible form, using clear and plain language: such information will be provided in writing or by other means, including electronic means where appropriate, or, upon the user&#8217;s request, orally provided that the user&#8217;s identity can be proven by other means.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.4.<\/strong>&nbsp;In compliance with Article 12, paragraph 3) of the GDPR, PERSEVERANZA informs that it undertakes to provide the user with information on the action taken on a request under Articles 15 to 22 of the GDPR without undue delay and in any event within one month of receiving the request; this period may be extended by two months if necessary, taking into account the complexity and number of requests (in such a case, the data controller undertakes to inform the user of such an extension and the reasons for the delay, within one month of receiving the request).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>5.5.<\/strong>&nbsp;The user may exercise the above-described rights (except for the right under Article 77 of the GDPR) at any time using the contact details provided in Article 6.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">6. <strong>Contact Information<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>6.1.<\/strong>&nbsp;PERSEVERANZA can be contacted at the following address: info@cantinaperseveranza.it<\/p>\n\n\n\n<h3 class=\"wp-block-heading\">7. <strong>Social plugins.<\/strong><\/h3>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>7.1.<\/strong>&nbsp;In accordance with the EDPB Guidelines No. 7\/2020, PERSEVERANZA also specifies that it acts as a joint data controller under Articles 4(7) and 26 of the GDPR with some social media providers (e.g., LinkedIn; YouTube), due to the installation of related social plugins within the Site, which are easily viewable and accessible on the Site.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Modena. 1 September 2024 (date of last update)<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/enterprime.it\/cookie-policy\/#_ftnref1\">[1]<\/a>&nbsp;<br>Cf. Recital 30 of the GDPR (&#8220;Natural persons may be associated with online identifiers provided by their devices, applications, tools, and protocols, such as IP addresses, cookie identifiers, or other identifiers such as radio frequency identification tags. These identifiers may leave traces which, when combined with unique identifiers and other information received by the servers, may be used to create profiles of natural persons and identify them&#8221;), and Article 122, paragraphs 1) and 2) of the Italian Privacy Code (&#8220;1. The storage of information in the terminal device of a contracting party or user or access to information already stored is permitted only on condition that the contracting party or user has expressed their consent after being informed in a simplified manner. This does not preclude any technical storage or access to information already stored, if aimed solely at carrying out the transmission of a communication over an electronic communications network, or to the extent strictly necessary for the provider of an information society service explicitly requested by the contracting party or user to provide that service. For the purposes of determining the simplified methods referred to in the first period, the Italian Data Protection Authority also takes into account the proposals formulated by the most representative associations at the national level of consumers and the economic sectors involved, also with a view to ensuring the use of methods that ensure the actual awareness of the contracting party or user. 2. For the purposes of expressing consent as referred to in paragraph 1, specific configurations of computer programs or devices that are easy and clear for the contracting party or user to use may be employed&#8230;&#8221;); see also, page 15) of the Decision No. 231 of 10 June 2021 signed by the Italian Data Protection Authority: &#8220;&#8230;there is still, to date, no universally accepted system of semantic coding of cookies and other tracking tools that allows for an objective distinction, for example, between technical cookies, analytics, or profiling cookies, except based on the indications provided by the data controller in the privacy policy [&#8230;] with the hope that a general coding system will be reached promptly.&#8221;.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/enterprime.it\/cookie-policy\/#_ftnref2\">[2]<\/a>&nbsp;Cookies designed to collect and store data while a user accesses a website, disappearing once the user closes the related browsing session.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/enterprime.it\/cookie-policy\/#_ftnref3\">[3]<\/a>&nbsp;Cookies that are intended to last for a predetermined period (e.g., minute; months; years).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/enterprime.it\/cookie-policy\/#_ftnref4\">[4]<\/a> Analytics cookies are usually used to assess the effectiveness of an information society service provided by a publisher, to design a website, or, ultimately, to help measure its traffic (i.e., the number of visitors, possibly broken down by geographical area, connection time slot).<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/enterprime.it\/cookie-policy\/#_ftnref5\">[5]<\/a>&nbsp;Cf. Decision No. 231 of 10 June 2021 signed by the Italian Data Protection Authority, pages 13\/14: &#8220;The structure of the analytics cookie should then provide the possibility that it is attributable not only to one, but to multiple devices, in order to create reasonable uncertainty about the identity of the subject receiving it. This effect is usually achieved by masking appropriate portions of the IP address within the cookie. Given the representation of IPv4 addresses (32-bit), which are usually represented and used as a sequence of four decimal numbers between 0 and 255 separated by a dot, one of the measures that can be implemented to benefit from the exemption consists of masking at least the fourth component of the address, an option that introduces an uncertainty in the attribution of the cookie to a specific data subject of about 1\/256 (approximately 0.4%). Similar procedures should be adopted in reference to IPv6 addresses, which have a different structure and a vastly larger addressing space (being made up of 128-bit binary numbers). The Italian Data Protection Authority also emphasizes the need for analytics cookies to be used solely for producing aggregated statistics and that they should be used in relation to a single website or a single mobile application, so as not to allow the tracking of the navigation of the person using different applications or browsing different websites. It is therefore understood that third parties providing the web measurement service to the publisher should not, in any case, combine the data, even if minimized, with other processing (such as client files or statistics of visits to other sites) nor should they pass them on to further third parties, under penalty of an unacceptable increase in the risks of user identification; except in cases where the statistics they produce with the minimized data concern multiple domains, websites, or apps attributable to the same publisher or business group. However, it is possible to consider lawful, even in the absence of the prescribed minimization measures, the use of statistical analyses related to multiple domains, websites, or apps under the same owner, provided that the owner conducts the statistical analysis internally. In any case, such analyses should not go beyond mere statistical counting and take on the characteristics of processing aimed at making commercial decisions.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Az.
